EU Return and Exchange Policy (Consumer Protection Directive Compliance)

These terms and conditions are formulated in accordance with the EU Consumer Protection Directive (Directive 2011/83/EU) and its amendments (such as EU 2024/825, EU 2023/2673), and apply to the return and exchange of clothing products purchased by all consumers within the EU (hereinafter referred to as "you") through the official website of ICARUS TECH TRADING CO., LTD (hereinafter referred to as "we") (icarustechco.com) or other channels. Please read these terms and conditions carefully before purchasing, as your purchase constitutes acceptance of all the terms and conditions. I. Cooling-off Period and Right to Return

As a consumer within the EU, you are entitled to a 14-day cooling-off period (also known as the "right of withdrawal"), calculated from the date you actually receive the purchased clothing product. During the cooling-off period, you have the right to return the purchased product unconditionally without providing any reason, and without incurring any liability for breach of contract. If the last day of the cooling-off period falls on a non-working day (including weekends and EU public holidays), the deadline will be extended to the next working day.

Special Reminder: If we did not explicitly inform you of this cooling-off period right at the time of purchase, your return period will be automatically extended to 1 year and 14 days, and we will bear the return shipping costs incurred during this period.

II. Conditions for Returned Products

To ensure your return rights are fulfilled smoothly, returned clothing products must meet the following conditions:

  1. Product Condition: Unworn, unwashed, unaltered, free of stains, damage, or signs of use, and in brand new condition;
  2. Packaging and Accessories: The original product packaging must be intact, with all tags, labels, and other accessories complete. The invoice and order receipt provided at the time of purchase must also be returned;
  3. Special Notes: For clothing sets containing multiple items, the entire set must be returned; individual items cannot be returned. If the product is damaged due to improper storage or use, it will be considered ineligible for return, and we reserve the right to refuse the return request.

III. Circumstances Where the Cooling-Off Period Does Not Apply for Returns

According to relevant EU regulations, the 14-day cooling-off period for no-reason returns does not apply in the following situations:

  1. Promotional clearance products: Clothing clearly marked "Final Sale" and "No Returns or Exchanges," and you confirmed that you were aware of this labeling at the time of purchase;
  2. Products damaged due to your own fault: Clothing damaged due to improper wearing, washing, or storage, not due to product quality issues.

IV. Return and Exchange Process

(I) Return Application

  1. You must submit a return application within the cooling-off period or after confirming a product quality issue, using the following method: Send an email to partner@icarustechco.com, with the subject line "EU Return Application + Order Number," and the body of the email must include your name, contact information, order number, reason for return, and product details;
  2. We will review your application within 3 business days of receipt. Upon approval, we will send you a confirmation email containing the return address, return item number, and relevant precautions; if the application does not meet the requirements, we will explain the specific reasons in the review email.

(II) Product Return

  1. Within 7 business days of receiving the return confirmation email, you must pack the eligible products along with relevant accessories, label the package with the return number, and send it to the designated return address via your chosen logistics method.
  2. For returns without a reason during the cooling-off period, you will bear the logistics and transportation costs unless we have not informed you of the return cost. If the return is due to product quality issues (such as fabric defects, incorrect patterns, workmanship defects, etc.), we will bear the transportation costs. You can keep the logistics receipt upon return and apply for reimbursement of shipping costs later.

(III) Acceptance and Refund/Exchange

  1. After receiving the returned products, we will complete the acceptance within 5 business days. Once the acceptance is satisfactory, the refund or exchange process will be initiated.
  2. Refund: We will refund the purchase price to your original payment method. The refund amount will be the actual amount you paid for the goods (excluding the return shipping costs you borne). Refund processing time may vary depending on the payment institution and bank, generally taking 3-10 business days.
  3. Exchanges: If you request an exchange (e.g., changing size or color), and the replacement product is in stock, we will arrange shipment as soon as possible after acceptance. Secondary shipping costs incurred during the exchange process will be handled according to the provisions of Section 2 of this article, depending on the reason for the return. If the replacement product is out of stock, we will negotiate with you to offer a refund or exchange for another similar product.

V. Special Provisions Regarding Quality Issues

If the clothing you receive, under normal wear and use conditions, experiences non-human-caused damage such as fabric quality issues or workmanship defects, and the 14-day cooling-off period has expired, you may file a quality claim with us within a reasonable period (not exceeding 2 years from the date of receipt of the product), in accordance with relevant EU product quality guarantee regulations.

When filing a quality claim, you must provide clear photos or videos of the product's quality problem and cooperate with our quality assessment. If the issue is confirmed to be a product quality problem, we will provide you with free return and exchange services, or, according to your needs, solutions such as repair or price reduction compensation. All related transportation and assessment costs will be borne by us.

VI. Data Protection and Privacy Statement

During the return and exchange process, we may collect and process your personal data, including return application information, logistics information, and product acceptance information. All data processing strictly adheres to our EU Privacy Policy (GDPR Compliance).

We will encrypt and store your return and exchange related data solely for processing return and exchange matters and fulfilling our legal obligations. This data will not be disclosed to any third party. The data retention period is 3 years after the return and exchange matter is completed; after this period, it will be automatically anonymized.

VII. Dispute Resolution and Complaint Channels

If you have a dispute with us regarding returns and exchanges, we recommend prioritizing communication and negotiation via email. If negotiation fails, you have the right to file a complaint with the consumer protection agency of your Member State or to initiate legal proceedings in a court with jurisdiction.

According to the EU Online Dispute Resolution Regulation (ODR), you can also submit a dispute resolution application through the EU Online Dispute Resolution Platform. We will actively cooperate with the relevant institutions in their mediation efforts.

This refund and exchange policy is effective from the date of publication. If there are any updates to the relevant EU laws and regulations, we will revise this policy in accordance with the latest regulations. The revised policy will be published on the official website (icarustechco.com) and you can check it at any time.
